Uninsured/Insured Motorist Accidents
Protecting Your Family Against Unexpected Financial Hardship
In 2014, the Insurance Journal estimated more than 20% percent of Florida drivers do not have auto insurance. What recourse do you have if you have been injured or lose a loved one due to the carelessness of an uninsured motorist? You can take out uninsured motorist coverage on your own car insurance policy. Uninsured motorist coverage pays for medical expenses and related costs if you are ever injured in a serious car accident by an uninsured or underinsured driver.
We Care About Your Health
The personal injury attorneys at the Baird Law Group want to see you and your family protected after a catastrophic car accident. That is why we are urging everyone to take a minute today to review the most important coverage you have — your uninsured motorist coverage.
Minimum Coverage Under Florida Law
Drivers in Florida are not required to carry liability insurance coverage. Every driver by law, however, must carry Personal Injury Protection, or PIP, which covers medical expenses and up to 60 percent of lost wages. The total payout is limited to $10,000 per person per accident — not enough to cover the expenses of a serious car accident, which often costs thousands more to treat.
If you carry uninsured motorist coverage, you can make a claim against your own insurance policy up to the dollar limit of your policy. If you have been injured by an underinsured motorist, your insurance will supplement the amount paid by the at-fault driver.
Making an Informed Decision
The attorneys at our firm recommend carrying “stacking” uninsured motorist coverage. This cost-effective coverage protects you against a car accident, motorcycle accident or pedestrian accident with an uninsured or underinsured motorist.
If you decline uninsured motorist coverage, you must by law sign a waiver of coverage, and your file must have a copy of the disclaimer. If the agent failed to request or file the signature, your insurance company may be forced to provide coverage.
