Public swimming pools and pools managed by apartment complexes and homeowners associations

SARASOTA, Fla. – Ten-year-old Alexander Castanon is being called a hero by local police and residents after he saved a three-year-old neighbor from drowning in a pool at the apartment complex where they live.

Alexander was swimming in the pool near Natalee Lopez who was being watched by an adult relative. When a grill near the pool suddenly began shooting flames into the air, the adult jumped from the pool and became distracted. During the confusion, Natalee slipped out of her “swimmies,” inflatable arm rings used for flotation, leaving her with only a swim ring to keep her afloat. In the few moments that followed, Natalee slipped upside down and was unable to keep her head above water.

Fortunately for Natalee and her family, Alexander noticed the child was having trouble and pulled her to the side of the pool while he and other children yelled for help. Although Natalee had taken water into her lungs and had stopped breathing, relatives performed CPR and the child began breathing on her own. After being evaluated by paramedics, Natalee was flown by helicopter to a nearby medical center where she remained overnight for observation and to ensure she would not develop pneumonia.

Sarasota Police Chief Bernadette DiPino congratulated Alexander for his “quick thinking and bravery,” applauding him for his heroism.

Fortunately for Natalee and her family, this incident didn’t result in serious injury; however, even this event will likely involve substantial hospital bills and other medical costs. According to data from the Centers for Disease Control and Prevention (CDC), an average of 10 people drown each day in the U.S. and more than 5,600 people are treated in emergency rooms each year for near-drowning incidents. Most swimming pool deaths and nonfatal injuries involve children four years of age and younger.

Public swimming pools and pools managed by apartment complexes and homeowners associations have insurance companies protecting them and their interests. In an ideal world, these same insurance companies would see to it that medical costs associated with accidents that occur on these properties are taken care of. But in the real world, that rarely happens without a legal battle. That’s why, if you’re a victim of an accident, it’s essential to have an attorney who’s willing and able to aggressively defend your rights and pursue all the responsible parties.
